These Terms govern your use of Rimetry (the "Service"), operated by Rimetry ("Rimetry", "we", "us"), reachable at hello@rimetry.com. By accessing or using the Service you agree to these Terms.
1. The Service
Rimetry provides outage detection, uptime monitoring, status pages, alerting, and related APIs for websites and online services. Plans, features, and limits are described on our pricing page.
2. Eligibility & accounts
You must be of legal age in your jurisdiction (or have authority to bind your organization). You are responsible for the confidentiality of your account credentials and for activity under your account. Keep your account information accurate and up to date.
3. Acceptable use
You agree not to:
- use the Service unlawfully, fraudulently, or to send spam;
- infringe intellectual property or privacy rights of others;
- probe, scan, scrape, reverse-engineer, or interfere with the Service or its security;
- upload malware, attempt unauthorized access, or circumvent technical limits;
- monitor endpoints you are not authorized to monitor.
4. Intellectual property
Rimetry and its licensors retain all rights, title, and interest in the Service, including software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain rights to data and content you submit; you grant us a limited license to host and process it solely to provide the Service.
5. Payments & subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refunds are governed by Paddle's Checkout Buyer Terms and our Refund Policy.
6. Service availability
We work hard to keep Rimetry reliable, but we do not guarantee uninterrupted or error-free operation. Monitoring results are provided as-is and may be affected by network conditions, third-party providers, and the target service itself.
7. Suspension & termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You may cancel at any time via your account. On termination, your right to use the Service ends and we may delete your data after a reasonable export window.
8. Warranties & liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. Our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Indemnity
You agree to indemnify Rimetry against claims arising from your content, your use of the Service in violation of these Terms, or your violation of applicable law or third-party rights.
10. Changes
We may update these Terms from time to time. Material changes will be announced on this page or by email; continued use of the Service after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Rimetry is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.
